On March 18, 2009 New Mexico became the third state in two years to abolish the death penalty, joining New York and New Jersey.
Nationwide statistics point to a disparate impact of capital punishment sentencing on indigent and minority defendants. In 96% of states where there have been reviews of race and the death penalty, there was a pattern of either race-of-victim or race-of-defendant discrimination.
Since 1973, over 120 people have been released from death row due to evidence of their innocence.
