
While Supreme Court nominee Elena Kagan has been criticized in some quarters for her lack of judicial experience, Justice Antonin Scalia, for one, is glad to see a nominee who has not previously been a judge. In a speech sponsored by Catholic University’s Columbus School of Law, Scalia pointed out that while all the current members of the court have been federal judges, when he came to the court in 1986, three members (Rehnquist, White, and Powell) were not. He stated that he views the promotion of judges through the system as "dangerous" because it follows the "European system" of professional judges.
