In a previous post, we wrote that Senate Judiciary Committee Chairman Patrick Leahy of Vermont was considering legislation that would allow retired Supreme Court justices to return to the bench to help decide cases when there is a recusal. On Wednesday, Leahy introduced such a bill. According to a press release, the bill would require the majority of active justices to vote to designate and assign a retired justice to return in such cases.
