Attorney Adam Freedman, host of the Legal Lad, writes in a recent Wall Street Journal article that a persuasive and elegant brief has all the harmony of great prose.
He offers several suggestions for writing a persuasive brief:
-
Boil down your arguments to a single theme - with the right theme, a legal brief can tell a compelling story
-
Eliminate legalese and use the plainest language possible - everybody hates legalese, even judges
-
Concede any obvious weaknesses in your case up front - that will clear the air and let the judge focus on the merits of your argument
-
Edit out anything that does not advance your theme
