Most cases litigated in the United States are resolved prior to trial. This course will focus on the development of pre-trial advocacy and litigation management skills through the use of simulated exercises. The course will provide students with hands-on experience with all aspects of the pre-trial litigation life cycle, from pre-suit investigation, pleadings, litigation management, discovery and motion practice. Through the use of simulated case files, students will be given the opportunity to develop the skills necessary to prepare a case for trial, including fact investigation, preparing and responding to pleadings and written discovery, taking and defending depositions of fact and expert witnesses, and briefing and arguing dispositive motions. Suggested preparation: Evidence.
