The objective of this course is to instill a critically sound understanding of the core issues inherent in the prosecution and defense of capital cases. To this end, the course is organized around three broad subjects: reconciling death penalty schemes with evolving constitutional requirements, fair trial issues unique to capital cases, and the nagging problem of convicting--and executing--factually innocent persons. In addition to studying trial and appellate court decisions and actual case files, guest speakers and documentary videos will offer real world insights into capital litigation. A mid term exam and short final paper will be required.
