This course provides in-depth analysis of selected topics in bankruptcy law, including confirmation of Chapter 11 business reorganization plans; the scope and limits of bankruptcy court jurisdiction; conflicts between the Bankruptcy Code and other federal laws including labors laws, environmental laws, and ERISA; treatment of intellectual property rights in bankruptcy; the relationship between the federal bankruptcy law and sate law; and the treatment of secured claims. The course will include some discussion of significant policies and principles that underlie the Bankruptcy Code. Where appropriate, we will devote particular attention to legislative developments and recent United States Supreme Court rulings on bankruptcy topics. Bankruptcy and Secured Transactions are recommended, but not required, preparation for this course.
