This course focuses on a rapidly growing and changing aspect of law. The course begins by exploring the concepts of individual and systemic disparate treatment in cases interpreting Title VII of the Civil Rights Act. We then explore alternative approaches to combatting discrimination found in the Americans with Disabilities Act. We begin by considering the meaning of qualified individual with a disability under Title I of the Americans with Disabilities Act and by exploring theories of disability discrimination under the ADA and the Rehabilitation Act including individual disparate treatment, failing to provide reasonable accommodations, and discriminatory qualifications standards. The recent amendments to the ADA in which Congress responded to years of judicial misinterpretation of the ADA, together with the amendments of the associated regulations, provide an excellent opportunity to see Congress, the Courts and the administrative agencies in action. Fundamentals of statutory construction and litigation strategy are emphasized. Numerous unresolved legal issues are addressed throughout the course. Students will be required to complete written exercises throughout the course as well as a final examination. Enrollment is by permission of the instructor.
