This seminar will explore problems in the relationship between federal authority and state law. It will have three parts. For the first five weeks, we will consider the various doctrinal principles that lawyers invoke in dealing with problems in federalism. The seminar will then recess for the next five weeks in order to give the seminar members time to prepare their 2-unit papers for presentation to the seminar for the last four weeks that we meet. Prerequisite: Federal Courts (Law 659).

- Notes: This 2-credit seminar on Federalism will meet for 7 weeks from 6:30-9:15 on Wednesday nights. The classes will be organized to cover the 10th Amendment, the Commerce Clause, the Spending Clause, reverse federalism and individual rights, and case studies of health care reform, marijuana, same sex marriage, and possibly other topics as time allows. Response papers will be required. Class participation will be heavily weighed for the final grade, along with one class presentation and the response papers. No final paper is required, but an optional 1-credit SRP is available, which requires a 10-page paper due at the end of the semester. Constitutional law is a prerequisite; Federal Courts is recommended.
