Inst Design in the Law of Work

This course surveys the range of institutional design options for building or retrofitting the enforcement of American labor and employment law. Institutions to be studied include traditional civil court litigation (private enforcement), worker compensation schemes, unions, agency prosecution and adjudication, arbitration, standard-setting and monitoring by non-governmental organizations, criminal enforcement, and specialized judicial forums. Specific areas of law include union organizing, workplace safety, employment discrimination, and unemployment compensation. Each seminar participant must write a research proposal, conduct original research, and submit a final paper. Grades will be based on the research proposal, the final paper, and class participation. The course lasts one academic year, meeting regularly in the fall semester, and reconvening in the spring for student presentations.
