This experiential seminar serves as an introduction to the skills, process and ethics of mediating. Time will be spent learning the different forms that mediation can take and the different ways that effective mediators can 'add value' to the negotiation process by helping disputants better achieve their goals. Students enrolled in the seminar will study the basics of negotiation theory and the barriers that negotiators face in resolving their own disputes. Students will also participate as disputants and representatives in simulated mediation sessions and other skill-building exercises; observe actual mediations and other public and private consensual dispute resolution processes; and consider various law and policy issues in the field. The course is useful to students wishing to serve as litigators, counselors or negotiators, as well as those considering a career in mediation.
