Education Law

In this course, we study the legal questions governing public education. Schools provoke fundamental questions about who belongs and who falls outside our concept of community. These questions require examination of the relationship between the state and parents, between the state and other social commitments like religion, and between children and adults. To approach these broad questions, we look at state and federal constitutional jurisprudence, including the right to a public education and the right to exemption from public education; religious establishment and free expression in public schools; privacy; student discipline; and free speech in public schools. We also study statutes affecting public education, including special education; the creation and organization of school districts; educator certification requirements; and labor relations. The final grade will be determined by class participation and a take-home exam.
