An examination of the various available means, short of litigation, of processing disputes in our society. Students will survey some of the principle theoretical issues concerning negotiation, mediation, arbitration, and other 'mixed' alternative dispute resolution processes. Students will participate in short mock negotiations, mediations and other alternative resolution processes in order to gain a more direct appreciation of the theoretical issues presented. In addition to these exercises, assessment will be based on written reflections on questions related to the assigned readings, as well as one essay on an ADR topic.
