Main Currents in Legal History

Treats select themes and developments in American law from the colonial period to the present. These include the transplantation (and Americanization) of the common law; the rise of the professional bar; capitalism and slavery in antebellum law; O.W. Holmes and the attack on legal formalism; legal realism and the critical legal studies movement. The seminar will emphasize current scholarship and relevant historical documents. Requirements: class discussion, several short papers and a take-home final examination.
