Judicial Independence

This seminar will explore the nature of judicial independence, its constitutional dimensions and its practical applications. Readings will include law review articles and selected court decisions pertinent to judicial independence and the related principle of the separation of powers. Through the lens of history, the course will also consider current issues in which judicial independence is at stake. Focus will center on judicial decision-making itself, judicial appointments and elections, the intersection of judicial independence and judicial accountability, and threats to the institutional independence of the judiciary as a branch of government. Class requirements will include active class participation and a research paper.
